Terms and Conditions

Use of this service is governed by applicable law, including the Drivers' Privacy Protection Act and related state laws (DPPA) and the Gramm-Leach-Bliley Act (GLBA). The data regulated by the DPPA and the GLBA may be used only for the permissible uses listed below:

By agreeing to the terms and conditions, you are certifying that the data will be used for one of the permissible uses above. The data provided to you by use of this product may not be used as a factor in establishing a consumer's eligibility for credit or insurance for personal, family or household purposes, employment or a government license or benefit or other purpose not permitted under the Fair Credit Reporting Act (FCRA)(15 U.S.C. sec 1681).

Please note that USATrace reserves the right to refuse or cancel any search request at any time for any reason with appropriate fees refunded to buyers account. In addition, if for any reason we suspect fraud or have received notice that funds are on hold for investigation, we reserve the right to verify the order or wait for funds to clear before posting the results. In such cases, we may request information from you or the credit card processor before your results are posted and results may not be posted within the original timeframe promised.


Balancing Privacy Issues

A) I understand that USATrace's costs, and fees are all associated with services and labor, and that no personal identifying information will be provided in its entirety in any reports including but not limited to complete ssn's and complete dates of birth to help balance privacy issues and at the same time provide in depth reports. If a full date of birth is found in the databases on the subject, it is included on the returned report and is truncated to only include month and year of birth, or year of birth, and we cannot guarantee accuracy as we cannot control information within 3rd party databases. In addition, all unlisted phone numbers will be kept confidential.

Q: Are the searches confidential?
A: YES, Absolutely, Positively. All searches are completely confidential. We will never make our clients' search requests available to a third party.

Q: Will the person I requested information about know that I am trying to find his/her information?
A: No, never. The subject has no way of knowing about the search or who ordered it. The same holds true for any type of search we provide - no one will know about your search unless you tell them yourself.



Refund Policy

A) Accuracy of search criteria submitted by the user (you) will directly determine search results.

B) If you provide a name or ssn on an individual which has been determined to be a minor we will issue a refund. The databases we access automatically withhold and do not store information on minors because the subject must be at least 18 years of age and have an archived file from consumer reporting agency files to be included in the databases.

C) If you provide a name and or ssn on an individual which has been determined to be a celebrity we will issue a refund.

D) If you accidently or purposly omit information on a search request form which prohibits us from conducting the search, we will promptly e-mail you asking for the omitted information so we may proceed with the search request which you ordered. If you are unable to provide the omitted information to us within 48hrs. we will refund your fees.

E) If you provide us search criteria with the subject's name and ssn (SSN Trace), subject's name and address (Address Search), or just the subject's name(Address Search) on an order, and we find no information or conflicting information on the subject which you provided, we will e-mail you back asking for additional information on the subject to help in a successful completion or clarification of the search. If we still cannot find any information whatsoever on the subject, or the subjects name is way too common of a name for an accurate search, we will refund your fees at your request.

F) If you accidentally submit erroneous information on a subject we will promptly e-mail you before we return the results asking you to please verify the search criteria. However, Accuracy of the information submitted by the user(you) will directly determine search results and USATrace. will not be held responsible for information submitted on search request forms by the user that later has been determined to be incorrect after the search has already been completed by USATrace.com on the initial inquiry

Example:You submit incorrect names or ssn's and after you get results from us you tell us you accidentally submitted wrong search criteria on submission form. All the search submissions at USATrace.com are automatically logged by sophisticated programming scripts to prevent search criteria disputes from happening.

G) We will not provide information to you on an individual whose name does not match what you have provided to us on the original search ordered for security reasons. If after that time it has been determined that the information you have submitted to us is indeed incorrect we will then e-mail you asking you for the corrected information before we proceed and provide you the results of the report. If after that time we are unable to locate your subject based on the additional information you provided, you will be refunded.

H) We access records controlled by third parties and report the results to you. We incur a fee every time we access public records, and your fee is for our services and not the results. We cannot guarantee accuracy of any of the information we provide. In addition, if your subject has recently moved, we cannot guarantee that public records will be updated with the current address; therefore, what we provide is the last updated address.

I)If you order a report on a deceased individual, we cannot guarantee that you will receive a full report. Generally, reports will include addresses for the past 7 years and possibly 10. If you subject has been deceased for a long period of time, the information contained on a report decreases over time. If we cannot locate a report on a deceased subject, a refund will be provided. However, if we do locate a report, refunds are not issued regardless of what the report does or does not contain.

J)The extent of information provided in criminal records for each state varies and is governed by the laws of each individual state.  Only final convictions will be provided.  Information on arrests, deferred disposition, or cases that are considered open or undisposed are not provided because such cases are not considered final convictions.  We cannot guarantee the accuracy or completeness of criminal records provided due to various state laws governing the release of criminal records, and we do not provide refunds for criminal records searches due to the fact that payment is for the service and not the results. Not all subjects we perform criminal records searches on will have criminal records, but the fee is still considered valid because our clients are paying for the service and not the number of records a criminal records search may pull.

Some people want to know why we do not process results instantly. We differ from many companies because our reports DO NOT rely solely on automated searches. We assign an actual researcher to each report to gather as much information as possible so you receive high-quality, relevant results. This is why it may take some time to post your report.

Please use the table below to determine when your report will be posted. This table is based on Central Standard Time. The left side of the chart contains various times you may place an order,and top of chart contains various days you may place your order. Use these two fields to determine when your order will be posted. We have a policy of providing results the same day you order. The only time a result may post on the next day would be if you purchased between 6pm and 11:59pm Central Standard Time. When the posting system is unavailable due to system updates or technical issues, we will email results to the primary paypal email address on file.

Echecks are processed after they are cleared. It takes 2-5 business days for Echecks to clear.


Fraud Alert

In certain situations our automatic fraud alert system will be triggered by an order and your account will be disabled termporarily. This occurs for various reasons including but not limited to the following:


When the fraud alert is triggered we will either refuse to process the order and issue a refund or we will request additional information to verify your identity. This information will be verified in our system along with the IP address information that is automatically logged in our system when you purchase a report on our site. We reserve the right to disable an account that triggers the alert system until a client can provide the information necessary to enable the account. In cases where additional information is requested, the turnaround time discussed in Section 4 of these terms and conditions may be longer.


Chargebacks and Reversals

We handle all Chargebacks and reversals as potential cases of fraudulent use of our services and/or theft of services. In cases where we have provided a service and we have verified that a client has successfully downloaded a report, possible actions taken by the company may include disabling access to your account, filing a complaint with the Internet Crimes Bureau or local authorities, contacting subjects a client ran a search on in order to warn them of potential fraudulent use of their identities or personal information, or reporting the incident to paypal which could result in your paypal account being frozen. Please be advised that all activity and IP address information is being monitored on the site. This information may be used in a case against you if there is fraudulent use or theft of services.


Disclaimer/ Limitations

A) By accepting these terms and conditions you understand and accept these terms and conditions outlined above when you submit this order and search request. You also agree that this information will not be used in any harmful, negligent, or illegal manner, and you will abide by all rules and federal and state laws governing use of this information. You also agree that Neither USATrace, nor any of its providers of information shall incur any liability for the inaccuracy of any information contained in the reports provided by UsaTrace, or for any delays or omissions therein.

B) By accepting these terms and conditions you release USATrace or any affiliates including any information providers public or private from any and all liability but not limited to losses, damages or injuries in any way connected with the information or dissemination of information provided to you by USATrace, but not limited to, inaccurate information, omitted information, or delayed information. Also, by accepting these terms you agree that you will not use this information or disseminate this information in any harmful, negligent, or illegal manner.
